Question : Is there a prevailing BC BUILDING CODE condition in the existing renovation permits and licences as issued to the landholder &/or agent for the "Goodacre" property, supra, that there shall occur wheelchair access upgrades to the curbside access/exit zone and the interior access to elevator from ground floor ?

Dear Mister Tinney
Thank you for your reply and the information provided. Surfaces to the entrance to the elevators and lobby were replaced just prior to the sale to Starlight. And, Starlight is continuing to replace flooring in hallways of each building ... most floors are currently bare cement ... carpeting has been removed ... obviously, no work has been ongoing since before Christmas.

The work proposed would not trigger a requirement to upgrade the elevator or existing accessibility of the building unless they were proposing to replace either the elevator or surfaces to the entrance. They have not proposed either in the permit submissions made to date so there would be no building code requirement to satisfy.

This is because the building code does not apply retroactively and does apply in the same manner as if the entire building was to be constructed new today. The application of current building codes to existing buildings is done to the extent that a building is not made less safe than its existing condition. The following is the application article of code to existing buildings.

1.1.1.2. Application to Existing Buildings
1) Where a building is altered, rehabilitated, renovated or repaired, or there is a change in occupancy, the level of life safety and building performance shall not be decreased below a level that already exists. (See Appendix A.)
